This Privacy Policy forms part of the User Agreement, which is incorporated by reference therein. Capitalized terms not defined herein will have the meanings set forth in the User Agreement and related policies. This Privacy Policy covers information you may provide to Cougars.com through the Cougars.com website:

  • what personally identifiable information of yours is collected;
  • what organization is collecting the information;
  • how the information is used;
  • with whom the information may be shared;
  • what choices are available to you regarding collection, use and distribution of the information;
  • what kind of security procedures are in place to protect the loss, misuse or alteration of information under the company's control
  • your rights with respect to your data; and
  • how you can correct any inaccuracies in the information.

Your Privacy is very important to us at Cougars.com. At Cougars.com, we are committed to maintaining the trust and confidence of the visitors to our website Cougars.com is not in the business of selling, renting, or trading email lists with other companies and businesses for marketing purposes. Definitions.

The following definitions are in addition to the definitions in the Terms and Conditions that are incorporated by reference.

  1. “Age Verification Agreement” refers to a mandatory agreement that all Users must enter into to confirm they are at least eighteen (18) years old before accessing any area of Cougars.com.
  2. “Personal Information” means any information, including Sensitive Personal Data, submitted to Processor by or for Controller (including Controller's authorized users of the Services) or collected and Processed by Processor for Controller in connection with the Services, relating to an individual from which, or in combination or linked with other information, the identity of the individual can reasonably be ascertained. Personal Data includes, but is not limited to, an individual's name, address, contact information, credit or debit card numbers, bank account numbers or financial information, social security number or other identification number, driver's license, passport or visa information, e-mail address, user name, password, IP address, location data, transactional information, health or disability information, image, voice, consumer preferences, marital status, salary, occupation demographic information, information provided by the individual in connection with his or her relationship with Cougars.com.
  3. “Cougars.com Entities” collectively refers to Cougars.com's parents, affiliates, partners, joint ventures, correspondents, associates, subsidiaries, and their successors and assigns.
  4. “Co-Branded Pages” are web pages or registration forms that are shared between Cougars.com and another entity, where Users may provide personal information to both Cougars.com and the partnering entity.
  5. “User” means any individual who accesses and uses any area of Cougars.com, having verified their age and agreed to the Age Verification Agreement.
  6. “User Account” means the account created by an individual upon registration with Cougars.com, containing personal information and used to access services on the Site.

  1. A Special Note About Children.

    Entry to this Site requires age verification. Cougars.com requires all Users and users to be at least eighteen (18) years old to use any area of the Cougars.com Site and requires that all Users and Users agree to the terms of the Age Verification Agreement. Children are not eligible to use Cougars.com and we ask that minors (under the age of eighteen (18)) not to submit any personal information to us. If we learn we have collected or received personal information from a child under 18, we will delete that information. If you believe we might have any information from or about a child under 18, please contact us at support@cougars.com
  2. Security.
    1. Cougars.com has certain security measures in place to help protect against the loss and the unauthorized access, use, alteration, and disclosure of your personal information under our control. We use Secure Socket Layer (SSL), which digitally encrypts your information as it is transferred from your computer to Cougars.com. We take the following measures to protect user information once it is received by the Site:
      • employees have limited and controlled access to User information;
      • measures have been taken so that servers and the data stored thereon are in a secure physical location;
      • security software is used where Cougars.com determines it to be both appropriate and cost effective;
      • employees are informed of all security protocol on a regular basis; and
      • web security procedures are quality-assured weekly.
      The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Website, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. We urge you to be careful about giving out information in public areas of the Website like message boards. The information you share in public areas may be viewed by any user of the Website.

      Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our Website. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Website.
    2. Although we strive to keep your personal information secure, no security measures are absolute and fool-proof and there is always a possibility that a security breach could occur, resulting in the release of a User’s data or information.
  3. Information Cougars.com Collects.
    1. Our primary goal in collecting personal information from you is to provide you with a smooth and efficient experience while you're using Cougars.com's website services, and to keep you informed of opportunities available on those services. This allows us to provide services and features that are designed to meet your needs, and to customize our service to make your experience easier and quicker. To this end, we may share information you provide with Cougars.com-related entities worldwide, e.g. its parents, affiliates, partners, joint venturers, correspondents, associates and subsidiaries and their successors and assigns (collectively herein “Cougars.com Entities”).
    2. Information Collected During Registration.
      1. Personal Information. When you join Cougars.com using our online registration form, or by registering over the phone, we may collect your email address, User name, real name, password, phone number, and other personal information listed in the registration form. Your User name is used throughout Cougars.com to identify you to other Users. Therefore, you should be aware that if you use your real name as your User name, this information will be visible to others who visit the Site.
      2. Co-Branded Pages. You can also join Cougars.com via co-branded pages or co-branded phone numbers using the co-branded registration forms available on such pages or phone numbers. Cougars.com will only use the information you provide to Cougars.com by joining Cougars.com through co-branded online registration forms, phone registration, and through Cougars.com's online registration form in accordance with this Privacy Policy. If you register as a User through any co-branded pages or phone numbers, Cougars.com may share your information with the partnering entity listed on the co-branded page. Prior to completing the registration on any co-branded page or phone number, Cougars.com will notify you if your information will be shared with the partnering entity listed on the co-branded page or phone number. By completing the registration on a co-branded page or phone number, you consent to Cougars.com's disclosure of your information in accordance with the notices displayed during the co-branded registration process. In such event, the use of your information by the partnering entity will be subject to the terms and conditions of such partnering entity’s privacy policy, which may be less restrictive than this Privacy Policy.
    3. Contact Information.
      1. Telephone Number. Because we connect Users by telephone, we require you to enter a valid telephone number to connect with other Users through Cougars.com. At no time will we share your telephone number with any other Users with whom you communicate. Because Cougars.com initiates all calls, other Users cannot see your telephone number not even with Caller ID.
      2. Email, Mailing Address, and Phone Number. We may use your email, mailing address, and phone number to contact you regarding account activities, new product offerings, and communications relevant to your use of Cougars.com and its affiliates. If you do not wish to receive such communications from Cougars.com you have the ability to stop receiving these mail communications by providing your User name and email address in a Customer Support Form or by unchecking the box on the My Preferences page, which asks if you wish to receive such mailings. You will, however, always receive administrative emails from Cougars.com that are related to the usage and functionality of Cougars.com. You may not opt-out of these administrative emails unless you cancel your User account.
    4. SMS Text Messaging.

      By completing the verifying your number on the phone manager, you expressly consent to receive non-marketing and marketing text messages from Cougars.com, including text messages made with an Auto dialer, at the mobile phone number(s) you provide. You may opt-out of these communications at any time by replying STOP to any text message from Cougars.com or by otherwise contacting the Cougars.com as indicated below. You can receive help at any time by replying HELP to any text message from the Cougars.com or by otherwise contacting Cougars.com as indicated below. Consent to receive non-marketing or marketing text messages is not required to purchase any products or services from the Cougars.com. Messaging and data rates may apply. By completing the phone manager verification, you also accept and agree to be bound by these SMS Text Messaging Terms & Conditions and any other applicable terms and agreements related to your use of Cougars.comservices.
    5. Financial Information.
      1. Talker Listings and Earnings. If you have a Talker listing and/or are earning money on Cougars.com, we collect additional information from you in order to process and remit to you your Talker fees and/or verify your personal and/or listing information. We collect your mailing address to remit payments, and we collect your Social Security number and/or Federal Tax ID number to prepare Form 1099-MISC if necessary and to help us verify your identity. Users who are not United States taxpayers will not be asked for their Social Security numbers or Federal Tax ID numbers, though they may need to report income to their local tax authority and may be required to provide equivalent evidence of their identity.
      2. Credit Card Information. Cougars.com may collect credit card information, add money to your User account, or use your credit card to take advantage of special promotions. Cougars.com uses RocketGate to process credit cards for billing purposes. This third party may store or retain a User's personally identifiable information, Your credit card is not stored by Cougars.com on our site or servers. In certain cases, we will also use your partial credit card information to help us verify your identity. We do not charge or bill the credit card when we collect partial credit card information for identity verification purposes. Please refer to RocketGate's Privacy Policy for any questions regarding your stored payment information with them.
    6. Profile Information
      1. Updating Information. You can review, update and change some of your personally identifiable information including your email address, date of birth, and PIN number on the My Account page. You can review, update, or change your address and credit card information by going to the Add Money page on the Site, clicking on the “New Card,” and then adding your name, address, and new or corrected card number. You may correct, update, or hide any of your Cougars.com profiles by clicking on the profile name on the Account Dashboard page. You may also update, correct, or delete information by filling out an updated Customer Support Form or you may write to Cougars.com at Customer Support, Cougars.com, 110 South 7th Street, Philadelphia, PA 19106.
      2. Additional Profile Information. You may also provide Cougars.com with additional profile information (such as experience, affiliations, on-call schedule, etc.) that is displayed publicly on the Site, on your home page, or in your listings. Other than the profile information submitted by our Users, or a User's User name, Cougars.com does not disclose any personally identifying information to other Users without your permission. If you choose to use Cougars.com forums, know that any personally identifiable information that you post can be read, collected, or used by others, and could be used to send you unsolicited messages. We are not responsible for the personally identifiable information that you provide.
    7. Dispute Resolution and Site Administration.

      We use information we maintain about you, and other information we obtain from your current and past activities on the Site, to resolve disputes, identify potential liabilities, troubleshoot problems, and enforce our User Agreement. At times, we may look at your User account information and transaction history to identify problems or resolve disputes. To have your account, personal information and transaction history erased from our records, please submit your request in writing:

    8. Surveys and Promotions.
      1. We may from time to time run promotions in which we ask Users or visitors for demographic information (like their Zip Code, State/Province or age). We may also run contests on Cougars.com in which we ask Users or visitors for demographic information. We use this data to tailor your experience, showing content that we think you might be interested in and displaying the content according to your preferences. We also use demographic information to determine eligibility for certain promotions and contests.
      2. From time to time Cougars.com may ask Users to participate in surveys. Such surveys may ask Users for contact information (like their email address). We may use contact information from our surveys to send you information about our company.
    9. Cougars.com may contain links to other sites. Cougars.com is not responsible for the privacy practices or the content of such websites. We encourage you to review the policies of these sites.
    10. Cougars.com also facilitates communication among Users through our on-site Mail system. Messages sent via Mail are identified only by your User name.
    11. Cougars.com may use certain information collected from our Users in aggregate form to tailor our Users' experience at the Site, showing you content that we think you might be interested in, and displaying the content according to your preferences. Cougars.com may also supplement the information you provide by purchasing information relating to you from third-party data providers. Cougars.com uses this information to improve its marketing and promotional efforts.
    12. Usage Data and Analytics.
      1. Cookies. Cougars.com uses cookies. Cookies are small amounts of data sent to a user's browser from the Cougars.com Web servers and stored on a user's computer's hard drive. Cougars.com uses cookies to track the pages on the Site that our users visit. This allows us to collect aggregate information about usage on the Site. Cougars.com may also use cookies to deliver content specific to Users' interests, and to keep track of Users' User names and passwords so that Users do not have to re-enter them during a session. You may refuse to accept browser cookies by activating the appropriate setting on your browser. If you choose not to accept cookies, you may be unable to access certain parts of the Site.
      2. Google Analytics. When someone visits Cougars.com, we use a third party service, Google Analytics, to collect standard internet log information and details of visitor behavior. We do this to find out things such as a number of visitors to the various parts of the site. This information is only processed in a way which does not identify anyone. We do not make, and do not allow Google to make, any attempt to find out the identities of those visiting our website.
    13. IP Addresses.

      Cougars.com uses your IP addresses to help diagnose problems with our server and to administer the Site. Generally, IP addresses tell us the location from which a person is connecting to us, what service provider the person is using and which parts of the Site the Site user is visiting. We do not link IP addresses to anything personally identifiable. This means that your session will be tracked, but you will remain anonymous. We reserve the right to track IP addresses for the purposes of fraud prevention, and we reserve the right to release IP addresses to legal authorities.
    14. Email Correspondence.

      If you send Cougars.com email correspondence, or if other Users or other third parties send us email or other correspondence regarding a particular User’s activities or postings on the Site, Cougars.com may collect such information.
    15. Cougars.com strictly enforces and requires that all Users comply with its Anti-Spam Policy.
  4. Users' Data Protection Rights
    1. When provided for by applicable law, you have the right to ask us for a copy of your personal information; to correct, delete or restrict (stop any active) processing of your personal information; and to obtain the personal information you provide to us for a contract or with your consent in a structured, machine readable format, and to ask us to share (port) this information to another controller. You may be entitled to additional rights based on applicable data privacy laws in your jurisdiction.
    2. In addition, you can object to the processing of your personal information in some circumstances (such as where we are using the information for direct marketing).
    3. These rights may be limited, for example, if fulfilling your request would reveal personal information about another person, or if you ask us to delete information which we are required by law to keep or which we need to defend claims against us. In addition, Cougars.com recognizes the Global Privacy Control available in some web browsers. If your browser is configured to send this signal, Cougars.com will opt you out of Cougars.com's use of advertising cookies on that browser.
    4. To exercise any of these rights (including deactivating your Cougars.com account), you can get in touch with us - or our data protection officer - using the details set out below. Additionally, Cougars.com allows you to edit your personal information by accessing the “my account,” “my profile,” or a similar feature of the service you are using. Likewise, you can delete files or photos you have stored in your Cougars.com account by logging in and using the deletion functions that are available.
    5. If you have unresolved concerns, you have the right to report them to your local privacy regulator or data protection authority.
    6. When you are asked to provide personal information, you may decline. You may also use web browser or operating system controls to prevent certain types of automatic data collection. However, if you choose not to provide or allow information that is necessary for certain services or features, those services or features may not be available or fully functional. For example, to register with Cougars.com, to create a Cougars.com ID, and to use some Cougars.com services, the provision of some information is mandatory. If relevant information is not provided, then we will not be able to administer a Cougars.com account to you, or provide you with the Services requested. Other optional information, if not provided, may impact our ability to provide a personalized experience or tailored content or offerings.
  5. United States - Your State Privacy Rights.

    State consumer privacy laws may provide their residents with additional rights regarding our use of their personal information.

    States including California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Montana, Oregon, Tennessee, Texas, Utah, and Virginia provide (now or in the future) their state residents with rights, including the rights to:

    1. European Data Subject Rights.

    2. Legal Basis for Processing Personal Data

      We only use your information in a lawful, transparent, and fair manner. Depending on the specific personal data concerned and the factual context, when we process personal data as a controller for individuals in regions such as the EEA, Switzerland, and the UK, we rely on the following legal bases as applicable in your jurisdiction:
      1. As necessary for our contract: When we enter into a contract directly with you, we process your personal data on the basis of our contract in order to prepare and enter into the contract, as well as to perform and manage our contract (i.e., providing our services, features and services to account owners, and manage our relationship and contract, including billing, compliance with contractual obligations, and related administration). If we do not process your personal data for these purposes, we may not be able to provide you with all services;
      2. Consistent with specific revocable consents: We rely on your prior consent in order to utilize cookies to engage advertising and analytics partners to deliver tailored advertising and analysis of our website usage. You have the right to withdraw your consent at any time by visiting our cookie management tool, available Cookies Settings;
      3. As necessary for our (or others') legitimate interests, unless those interests are overridden by your interests or fundamental rights and freedoms, which require protection of personal data: We process your personal data based on such legitimate interests to (i) enter and perform the contract with the account owner and/or reseller providing you with the products and services (which includes billing, compliance with contractual obligations, and related administration and support); (ii) develop, test, and improve our products and services and troubleshoot products and services; (iii) ensure authentication, integrity, security, and safety of accounts, activity, and products and services, including detect and prevent malicious conduct and violations of our terms and policies, prevent or investigate bad or unsafe experiences, and address security threats; (iv) send marketing communications, advertising, and promotions related to the products and services; and (v) comply with non-EEA laws, regulations, codes of practice, guidelines, or rules applicable to us and respond to requests from, and other communications with, competent non-EEA public, governmental, judicial, or other regulatory authorities, as well as meet our corporate and social responsibility commitments, protect our rights and property and the ones of our customers, resolve disputes, and enforce agreements.
  7. Our Disclosure of Your Information.
    1. We may disclose aggregated information about our users, and information that does not identify any individual, without restriction. We may disclose personal information that we collect or you provide as described in this privacy policy to:
      1. Our subsidiaries and affiliates.
      2. Contractors, service providers, and other third parties we use to support our business[ and who are bound by contractual obligations to keep personal information confidential and use it only for the purposes for which we disclose it to them].
      3. A buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Cougars.com's assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by Cougars.com about our Website users is among the assets transferred.
      4. Third parties, if you opt-in to having your personally identifiable information disclosed to such parties. When you consent to disclosure to such third parties, such third parties may use your information in accordance with their privacy policies, which may be less restrictive than this Privacy Policy.

        Except as explicitly stated herein, we do not sell, rent, or trade any personally identifiable information to third parties.

        Cougars.com may disclose some personally identifiable information to vendors and third-party service providers in connection with communications and payments to Users and other aspects of operating and promoting Cougars.com's Site and Advisory Services. For example, Cougars.com uses other companies to deliver Cougars.com promotions, newsletter, and transaction emails, and we share your email address with this company unless you opt-out of receiving Cougars.com's promotions by unchecking the box on the My Preferences page which asks if you wish to receive such mailings. We gather statistics around email opening and clicks using industry standard technologies to help us monitor and improve our newsletter and mailing campaigns.       5. Appropriate authorities and to banks associated with your User account in order to prevent or report suspected fraud and illegal activities, in order to prevent harm to any persons or if Cougars.com believes in good faith that the law requires it. In some cases, the government can compel the disclosure of information about you, and Cougars.com will comply, in which case you authorize it to do so. You also consent to Cougars.com disclosing information about you in connection with disputes involving other Users, and to actual or potential parties to a lawsuit or action that Cougars.com is or may become involved in,

        (1) if Cougars.com is required to do so,

        (2) if Cougars.com reasonably believes that such disclosures will potentially mitigate its liability, or

        (3) for Cougars.com to enforce its rights.
    2. Cougars.com Entities worldwide, to provide you with our services and enable communication between users.
  8. Cross-Border Transfer

    Your personal information may be stored and processed in any country where we have Cougars.com entities or affiliates, and by using our Service or by providing consent to us (where required by law), your information may be transferred to countries outside of your country of residence, including to the United States, which may provide for different data protection rules than in your country. Appropriate contractual and other measures are in place to protect personal information when it is transferred to our, entities, affiliates or third parties in other countries.

    Some non-European Economic Area (EEA) countries are recognized by the European Commission as providing an adequate level of data protection according to EEA standards (the full list of these countries is available here https://ec.europa.eu/info/law/law-topic/data-protection_en). For transfers from the EEA to countries not considered adequate by the European Commission, we have ensured that adequate measures are in place, including by ensuring that the recipient is bound by EU Standard Contractual Clauses, or an EU-approved code of conduct or certification, to protect your Personal Information.   9. Retention Period

    We will retain your personal information for as long as needed or permitted in light of the purpose(s) for which it was obtained. The criteria used to determine our retention periods include: (i) the length of time we have an ongoing relationship with you and provide the Service to you; (ii) whether there is a legal obligation to which we are subject; and (iii) whether retention is advisable in light of our legal position (such as in regard to applicable statutes of limitations, litigation, or regulatory investigations).

    We strive to provide you with choices regarding the personal information you provide to us. We have created mechanisms to provide you with the following control over your information:

    2. Disclosure of Your Information for Third-Party Advertising. If you do not want us to share your personal information with unaffiliated or non-agent third parties for promotional purposes, you can opt-out using the Contact Us form and selecting “Opt-Out of Partner site Marketing” You can also always opt-out by logging into the Website and adjusting your user preferences in your account profile or by sending us an email with your request to privacy@cougars.com.
    3. Promotional Offers from the Company. If you do not wish to have your email address or other contact information used by the Company to promote our own or third parties' products or services, you can opt-out by using the Contact Us form and selecting “Opt-Out of Partner site Marketing” or at any other time by logging into the Website and adjusting your user preferences in your account profile by checking or unchecking the relevant boxes or by sending us an email stating your request to support@cougars.com. If we have sent you a promotional email, you may send us a return email asking to be omitted from future email distributions.
    4. Targeted Advertising. If you do not want us to use information that we collect or that you provide to us to deliver advertisements according to our advertisers' target-audience preferences, you can opt-out by using the Contact Us form and selecting “Opt-Out of Partner site Marketing”. For this opt-out to function, you must have your browser set to accept all browser cookies.

    We do not control third parties' collection or use of your information to serve interest-based advertising. However these third parties may provide you with ways to choose not to have your information collected or used in this way. You can opt out of receiving targeted ads from members of the Network Advertising Initiative ("NAI") on the NAI's website, https://thenai.org/opt-out/.
  11. Accessing and Correcting Your Information
